Tax lawyers and auditors of the EUCON team once again demonstrated high standards of professional support of clients.
The Kyiv Administrative Court of Appeal denied the appeal of the tax authorities and upheld the decision of the Kyiv District Administrative Court regarding the cancellation of the tax notice decisions in the amount UAH 13 million.
In particular, the lawyers managed to uphold the legal position of the taxpayer regarding the unlawfulness of determining the regular selling price level of national tv channel programmes for 12 UAH compared with the selling price of programmes to Inter TV channel. Tax inspectors did not take into account the portfolio approach to the formation of the selling price of programmes and the unlawfulness of the “sale analogues” method use to determine the level of the regular price.
Thus, lawyers have proved that the State Fiscal Service officials acted in a biased way and did not obey the law.
